FYI - The accessibility lawsuit against Target was settled out of court. A good summary is posted at
http://webaim.org/blog/target-lawsuit-settled/
To summarize the points made on the discussion board - the settlement is good news because a major corporation did face a financial consequence for poor design, but the bad news is that there was no major legal precedent set. The settlement does not admit any liability.
Another complaint is that because the settlement is only with the National Federation of the Blind, only screen reader issues will likely be addressed while needs for other audiences (e.g. motion impaired, hearing impaired) might be missed in the redesign.
It looks like the legal system will continue to grind on slowly.
