Orphan Works Update: Is the Legislation Fair to Copyright Holders?

From the Electronic Frontier Foundation (EFF) DeepLinks Blog, a post on both Lawrence Lessig’s opinion on this, and a retort by Gigi Sohn of Public Knowledge. Note that the EFF supports this legislation, but they do provide links to both Lessig’s and Sohn’s opinion. What do you think about the Orphan Works bill and it’s potential effect on education?

    In a word, no. And it will only get worse. I’m thrilled to see that Lessig has finally come around and opposes the bill. I may need to revise my opinions of him.

    If small time illustrators have to start tracking this stuff- scanning and submitting every sketch, every rough, updating copyrights and tracking period lapses so copyright doesn’t fall potentially to the corporations running the repositories (companies like Corbis) it’s definitely an undue burden. Read the TEACH Act Read about and understand Fair Use. They give educators everything they need. The Orphan Works legislation is being supported financially, by corporations like Corbis, that would potentially become an official repository.
